Silicon Knights Ordered to Destroy Unsold Unreal Engine 3 Games

Silicon Knights has been ordered to “recall and destroy” all unsold copies of its games built on Unreal Engine 3. According to a recent ruling by the North Carolina District Court, Silicon Knights shall “cease producing or distributing” and “recall and destroy” all unsold copies of Too Human, The Box/Ritualyst, The Sandman, X-Men: Destiny and Siren in the Maelstrom at its own expense.

A judge also ruled that Silicon Knights must now pay Epic an additional $278,000 in court costs, $2.09 million in attorney fees and $2.3 million in pre-judgment interest. Joined with the previous ruling that Silicon Knights owes Epic $4.45 million, Epic is now owed approximately $9 million.

"Epic Games appreciates the court's careful consideration of the motions and is gratified by the order," an Epic spokesperson told IGN.

The ruling comes more than five years after Silicon Knights sued Epic, alleging that Unreal Engine did not work as it was supposed to. Epic later counter-sued and the case went to trial earlier this year. While Epic eventually won, a judge ruled that even if Silicon Knights had proved victorious, they could only earn $1.

Of the five titles listed in the ruling, Too Human was released in 2008 and X-Men Destiny came out last year. The Box/Ritualyst refers to a canceled psychological thriller project, while Siren in the Maelstrom is the name of a project leaked back in 2009 and The Sandman is presumably an unreleased title.

Gears of War Series Surpasses 19 Million Sales

Epic Games has revealed the lifetime sales for the Gears of War series -- the 19 million copies sold span three releases since November 2006. In its first week alone, Gears of War 3 sold 3 million, while Gears of War 2 garnered 2 million sales in its first weekend. Not bad.

This is the second Xbox-exclusive series to share its significant success in the past weeks. Microsoft recently detailed the record sales for its Halo franchise, which cracked the 46 million mark leading up to Halo 4's release.

Coincidentally, today marks the sixth anniversary for Gears of War.The first Gears of War prequel entry, called Gears of War: Judgment, will release for Xbox 360 on March 19, 2013.

NBA 2K13 Has Record-Breaking First Week

2K has announced a record-breaking launch for NBA 2K13. In its first week, the game sold 49% more copies than the previous top game in the franchise, NBA 2K11, and saw increased sales internationally compared to previous years. NBA 2K13 also saw a 127% increase in the number of online games played compared to last year.

"Our early sales figures are a validation of our ongoing efforts to push this franchise to new heights," said 2K Sports vice president of marketing Jason Argent. "We owe it to our great fans to continually improve our title - year in and year out - and that's exactly what we've done with NBA 2K13."

NBA 2K13 launched on October 2nd, and a Wii U version will follow on November 18th. 2K Sports hasn’t revealed specific sales figures just yet, but we’ve reached out and will update this story if they provide any additional info. Until then, be sure to read our NBA 2K13 review.

FIFA 13 Sells 4.5 Million in 5 Days

EA has announced that 4.5 million copies of FIFA Soccer 13 were sold in the game’s first five days on sale. According to EA, that not only gives FIFA the biggest launch so far in 2012, but makes it the biggest sports video game launch of all time.

1.23 million copies were sold in the UK alone, making FIFA the second franchise ever to sell more than one million copies in the UK in 24 hours. FIFA was the number one game in 40 countries, with more than 800,000 players playing online simultaneously during the launch’s peak activity, giving FIFA 13 “the busiest day for online gaming for a single title in EA history.” More than 66 million online games have been played so far, accounting for 600 million minutes of online play.

“FIFA Soccer 13 is a critical and commercial success unprecedented in sports entertainment,” said EA Sports executive vice president Andrew Wilson. “Every minute of every day millions of fans around the world are experiencing what the critics have already said— FIFA Soccer 13 is the biggest and best sports game we have ever created.”

FIFA 13 launched on September 25th in the U.S., selling 353,000 copies in 24 hours ahead of its international launch on September 29th. A Wii U version will launch alongside the system on November 18th.

Amnesia: The Dark Descent Sales Pass One Million

Frictional Games revealed today that nearly 1.4 million people have purchased Amnesia: The Dark Descent. According to a blog post from the developer, 710,000 copies of the game were sold directly, as well as sales from inclusions in the Humble Indie Bundle and Steam’s Potato Sack Reunion. Overall, the sales add up to 1,360,000 units in all.

“Despite that huge number of sales, what I think is more interesting is how good the monthly sales still are,” Frictional noted. “Not counting any discounts, the monthly full price sales lie at over 10,000 units. This means that less than every 5th minute someone in the world is buying a copy of Amnesia.”

Frictional also hinted at its next project, which is currently targeted for a 2014 release. “At Frictional Games our main concern is our new super secret project. We do not want to say much about this project yet, but we can disclose that it will be horror and that it will be first person,” the post reads. “One of the things I was most disappointed with in Amnesia was that it never really managed to deliver any deeper themes, but was more like a shallow fright-fest. For the new project we want to change that and really try and bring a certain theme to the front. Our hope is that this will create a very special experience, creating horror in a much more disturbing way.”

Frictional notes that “the game's current status is that we have pretty much all tech working, and have started to playtest the first parts. Still, a lot is up in the air and the current design is bound to change.”

Capcom: Sold Resident Evil 6 Copies Were "Stolen"

Copies of Resident Evil 6 that appeared for sale in Poland last week were stolen, Capcom has confirmed.

As reported, the copies on sale were of the German PS3 version which were purchased from a store in the Polish city of Poznan.

“

At this time, all we can add is that it would appear this unfortunate incident is limited to a small quantity of stolen copies of the German USK PlayStation 3 version of the game.

Capcom has released a statement addressing the incident, which reads, "Capcom is currently undertaking a thorough investigation into reports that Resident Evil 6 is being sold ahead of its official October 2 release date.

"At this time, all we can add is that it would appear this unfortunate incident is limited to a small quantity of stolen copies of the German USK PlayStation 3 version of the game."

It's not currently known how many copies of the title were sold, or what will happen to those that got out into the wild ahead of schedule. One copy has even turned up on eBay, with the seller claiming that he "bought the game legally".

While it's not known what action Capcom will decide to take at this time, it's usually a fairly risky move to decide to play a game ahead of launch, especially if you're one of a handful of people to do so. While Battlefield 3 was one of the more recent titles to suffer a massive leak after appearing early on torrent sites, most people who downloaded it got away without punishment due to the sheer volume of people involved.

When console games leak though, it tends to be easier for companies to track who's been playing them and then take action. Back in 2007, Halo 3 leaked online to Microsoft's intense chagrin. As a result, the Xbox Live accounts of any gamers found to have played the game were banned until the year 9999.

So despite the fact you may be able to get your hands on a copy of Resident Evil 6 a bit early, it's probably best to wait for the time being. To help quench your thirst, check out our countdown of 30 reasons you should be excited for the game's (legitimate) release.
